ADULT CONSENT, RELEASE OF LIABILITY,
COVENANT NOT TO SUE, AND HOLD HARMLESS

In consideration of my participation in a Restoration Project Expedition program (hereafter, the “Activity”), the undersigned agrees as follows:

1. Being over the age of eighteen (18) years, understand and also sign on behalf of my child(ren) that our participation in the Activity may include, without limitation, the following risks and hazards: outdoor activities in various weather conditions and on various terrain; water hazards; accidental drowning; boat capsize and entrapment; exposure to plants, animals and other outdoor hazards; and physical exertion, any of which may result in damage to property, illness, bodily injury or death. I also understand that the Activity organizers do not assume responsibility for lost or stolen personal property. I am aware of the risks and hazards inherent in my participation in the Activity, and recognizing those risks and hazards, I wish to participate in the Activity.

2. I hereby release Restoration Project and its officers, employees, volunteers, and agents (collectively, “Releasers”) from any and all liability for any and all claims and causes of action which I may hereafter have on account of any and all injuries and/or damage that I may sustain, or any loss of any other sort, arising out of or relating to my participation in or attendance at the Activity, or incidental thereto, whether caused by the negligence of the Releasers or any other person.

In addition, I covenant and agree not to sue any of the Releasers, and agree to forever hold each of them harmless from any liability, claims, demands, actions, or causes of action whatsoever arising from my participation in the Activity, whether the result of the negligence of the Releases or any other person. This waiver, release, discharge, indemnification, and hold harmless shall not affect my rights and benefits under the “no fault” provisions of the Colorado Auto Accident Reparations Act to the extent those rights and benefits are applicable. Additionally, this waiver, release, discharge, indemnification and hold harmless shall not be applicable to negligence or carelessness with regard to the maintenance and mechanical servicing of a Restoration Project-owned or operated vehicle, or to actions constituting gross negligence, recklessness or willful and wanton behavior on the part of the Releases. This release of liability, covenant not to sue, and hold harmless agreement is made on behalf of, and shall be binding upon, me, my heirs, executors, administrators, personal representatives, and assigns, and shall be for the benefit of the Releasers and their successors and assigns.

3. I understand that if I do not observe rules and regulations for the Activity adopted by the Releasers, my participation in the Activity may be terminated and I shall be responsible for any costs of return transportation. I hereby agree to indemnify the Releasers and to assume and be responsible for all harm, injury or damage caused by me to any of the Releasers, the Releasers’ property or equipment, other persons or other personal property used in conjunction with the Activity.

4. I give permission for the Releasers to use any photo, audio recording or video recording of any aspect of the Activity that may include my voice or image, for any lawful purpose, including publicity and advertising, in print, internet, or other media. I understand I will not be entitled to any compensation for use of such images or recordings.

5. In the event of an emergency, I hereby give consent for Releasers to provide first aid or for medical, dental or hospital care prescribed by a medical professional. This care may be given under whatever conditions are necessary to preserve my life, limb or well-being. I understand that I am responsible for the costs of such care.

I acknowledge that if I rent camping gear I will be responsible for fixing and/or replacing any gear that becomes damaged while it's rented to me.

An additional waiver is required to participate in any Restoration Project experience. A link to obtain this waiver for all registrants will be shown on the confirmation page.

REFUND POLICY

  • Cancellations made on or before April 14, 2024 will receive a 100% refund
  • Cancellations made between April 15 and May 14 2024 will receive a 50% refund
  • Cancellations made on or after May 15, 2024 will receive no refund
